Welcome to Healing Hoof Steps, Inc. (“Healing Hoof Steps,” we,” “our,” or “us”). By accessing or using our website (the “Site”) or mobile application (the “App”) (together, the “Platform”), you agree to be bound by the following terms of use (“Terms”). If you do not agree with these Terms, please discontinue use of the Platform immediately.

1. Acceptance of Terms

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Notice, and all applicable laws. These Terms constitute a binding agreement between you and Healing Hoof Steps. You may also be subject to specific services or features on the Platform, which will be incorporated by reference into these Terms.

2. Eligibility and Account Registration

You must be at least 18 years old to use the Platform.
You may need to register for an account to access certain features. You agree to provide accurate, complete, and up-to-date information during the registration process.
You are solely responsible for maintaining the confidentiality of your account login credentials and for all activities under your account.
You agree to notify us immediately of any unauthorized access to or use of your account.

3. Use of the Platform

· The Platform and online services provide information about our programs, allow clients to access telehealth services, enable donors to make contributions, and support volunteer engagement.

You agree to use the Platform only for lawful purposes and in accordance with all applicable local, state, national, and international laws.
You may not:
- Use the Platform to transmit any malware or harmful code;
- Interfere with the functionality of the Platform or any related servers/networks;
- Use any data scraping, harvesting, or mining methods.

5. License and Platform Access

· Healing Hoof Steps grants you a limited, non-exclusive, non-transferable license to access and use the Platform for your personal use.

· You may not copy, modify, distribute, sell, or lease any part of our Platform, nor reverse engineer, or attempt to extract the source code of our software, unless permitted by law or with our written permission.

· By posting messages, creating or modifying a home page, chatting, uploading files, inputting data, transmitting e-mail, or engaging in any other form of communication (individually or collectively "Communications") to or through the web site, you hereby grant to Healing Hoof Steps a perpetual, worldwide, irrevocable, unrestricted, non-exclusive, royalty-free license to use, copy, license, sublicense, adapt, distribute, display, publicly perform, reproduce, transmit, modify, edit and otherwise exploit such Communications throughout the world, in all media now known or hereafter developed. You hereby waive all rights to any claim against Healing Hoof Steps for any alleged or actual infringements of any proprietary rights, rights of privacy and publicity, moral rights, and rights of attribution in connection with such Communications.

· You will be responsible for your own Communications and the consequences of posting or otherwise transmitting those Communications. Healing Hoof Steps does not represent or guarantee the truthfulness, accuracy, or reliability of any material posted or otherwise transmitted by web site users or endorse any opinions expressed by such users. Healing Hoof Steps does not generally screen, monitor or approve Communications from our web site users in advance. However, Healing Hoof Steps may, from time to time, participate in communications on the site, or review communications on the site. If Healing Hoof Steps does identify Communications which violate this agreement, or If we receive notification about a user regarding Communications which allegedly do not conform to this Agreement, Healing Hoof Steps has the right, but not the obligation, to investigate the allegations and determine in good faith and at its sole discretion whether to remove or request the removal of the Communication. We have no liability or responsibility to users for performance or nonperformance of such activities. Healing Hoof Steps reserves the right to expel users and prevent their further access to the web site for violating this Agreement or violating the law. We have the right, but not the obligation, to remove Communications that are abusive, illegal, disrespectful, disruptive, or otherwise problematic.

6. Intellectual Property

All content, including but not limited to text, images, graphics, software, logos, trademarks, and service marks on Platform, is the property of Healing Hoof or its licensors and protected by intellectual property laws.

7. Payments and Subscriptions

Certain features (e.g., vendor listing, premium tools) may require payment. You agree to pay all applicable fees as disclosed at checkout.
All fees are non-refundable unless expressly stated. We reserve the right to modify pricing at any time.

8. Privacy

Our Privacy Notice governs the collection and use of your personal information. By using the Platform, you agree to the practices outlined in our Privacy Notice.
You acknowledge that communications via the Platform may be monitored or stored as necessary to operate the service or comply with legal obligations.

9. Termination and Suspension

Healing Hoof Steps may suspend or terminate your access to the Platform at our sole discretion, with or without notice, for any reason including, but not limited to, violation of these Terms.
Upon termination, your access will cease, and obligations related to payment, content rights, and indemnities will survive.

The Platform and all services are provided on an "as-is" and "as available" basis. We make no representations or warranties of any kind, either expressed or implied, including, but not limited to, warranties of merchantability or fitness for a particular purpose.
Healing Hoof Steps makes no warranty, express or implied, with respect to the content, information, or services provided through, or in conjunction with, the web site. We make no guarantee of the accuracy, correctness or completeness of any information on the Site, and shall not be responsible for: (i) any errors of omission arising from the use of such information; (ii) any failures, delays or interruptions in the delivery of any content or service contained within the web site; and (iii) any defamatory, libelous or unlawful material contained within the Site, including user web pages, resumes, emails, profiles, opinions, advice, statements, memorandums or discussion board postings, or materials related to a users' use of the Site's chat features. Gathering email addresses from this site through harvesting or automated means is prohibited. Posting or transmitting unauthorized or unsolicited advertising, promotional materials, or any other forms of solicitation to other users is prohibited. Inquiries regarding a commercial relationship with Healing Hoof Steps should be made through our contact form.
We do not guarantee the accuracy, completeness, or reliability of any content or user-submitted information on the Platform.

The links found on the web site will let you leave our web site and go to sites operated by parties other than Healing Hoof Steps. The linked sites are often not under the control of Healing Hoof Steps, and we are not responsible for the contents of any linked site, or any link contained in a linked site that are not owned and operated by Healing Hoof Steps, or any changes or updates to such sites. In no event shall our aggregate liability exceed the total amount paid by you, if any, for use of the Platform during the six (6) months preceding the claim.

· Violation of rights of any third party.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Florida, without regard to its conflict of law principles.
You agree that any legal action or proceeding relating to your use of the Platform shall be brought exclusively in the state or federal courts located in Miami, Florida and you hereby consent to the jurisdiction of such courts.

14. Changes to Terms

Healing Hoof Steps reserves the right to modify these Terms at any time. We will post updated Terms on the Platform and update the “Last Updated” date. Continued use of the Platform after such changes constitutes your acceptance of the revised Terms.

15. General Provisions

· Severability: If any provision is found unenforceable, the remaining terms will remain in full force and effect.

· Waiver: No waiver of any provision will be deemed a further or continuing waiver unless expressly stated in writing.

· Entire Agreement: These Terms and our Privacy Notice constitute the entire agreement between you and concerning your use of the Platform.

· Notice: Notices under this Agreement shall be sufficient only if in writing and transmitted via personal delivery, delivered by a major commercial rapid delivery courier service, or mailed, postage or charges prepaid, by certified or registered mail, return receipt requested, to Healing Hoof, Attn: Legal Department, , 3942 Jace Dr, Crestview, FL 32539.

· Assignment: You may not assign your rights or obligations without our prior written consent. Healing Hoof Steps may freely assign these Terms.
